DSA - tech industry organisations concerned about return of ‘stay-down’ obligation for illegal content removed online

25/05/2022 (Agence Europe)A number of technology industry organisations, including DOT Europe and Developers Alliance, sent a letter to European Commission Vice President Margrethe Vestager and Internal Market Commissioner Thierry Breton on Tuesday 24 May, expressing their concerns about the reappearance of the ‘stay down’ provision in the latest version of the compromise text of the Digital Services Act (DSA), which is intended to ensure that illegal content is removed and that the same or equivalent content does not reappear. According to them, this notion - as reintroduced - would “considerably hamper freedom of expression”, pave the way to “constant surveillance”, and be “unworkable for companies”.
