Coordination of social security systems: EFBWW and FIEC are against exemptions from prior notification

On Friday 28 May, the European Federation of Building and Woodworkers (EFBWW) and the European Construction Industry Federation (FIEC) issued a joint statement denouncing any possible exemption from prior notification currently being discussed as part of the inter-institutional negotiations on the coordination of social security systems.

The two organisations explained that most postings in the construction sector are short, and that many postings would therefore not require this prior notification, adding that some companies will not hesitate to split up posting periods to benefit from the exemption.

If a posted worker has an accident, and there is no A1 form, the authorities of the sending and host Member States could blame each other. Furthermore, both organisations are concerned that this initial exemption will lead to possible time “extensions”.

The Portuguese Presidency of the EU Council has made a new proposal to make prior notification compulsory, but including a derogation system for A1 forms for short-term postings (see EUROPE 12728/22).
