On Monday 30 November, the European Commission published a series of responses to the “most pressing implementation questions” raised by the transport sector since the entry into force of some of the new provisions of the ‘Mobility I’ package (see EUROPE 12524/19) last August.
“The European Commission’s priority now is to ensure a common understanding and consistent implementation of the new provisions”, says the institution, which specifies that it will, if necessary, supplement this first “guide” addressed to drivers, road transport operators, and those responsible for enforcing the rules.
The clarifications published on Monday concern, more specifically, the provisions on ferry journeys, exceptional overruns of driving time, border crossings, team driving, driver return - which are particularly detailed, the reduction of weekly rest periods, and the prohibition on taking these rest periods in the vehicle cabin.
These last three points are still subject to criticism in some Member States. Seven of them - Lithuania, Bulgaria, Hungary, Romania, Malta, Cyprus and Poland - have brought actions before the Court of Justice of the EU on this subject (see EUROPE 12602/10).
