EU Council adopts new rules on digitalisation of judicial cooperation

04/11/2020 (Agence Europe)On Wednesday 4 November, the Council of the EU adopted the recasts of the Regulation on the electronic service of judicial and extrajudicial documents in civil and commercial matters and the Regulation on the digitalisation of cooperation between the courts of the Member States in obtaining evidence. The EU Council had already confirmed (see EUROPE 12533/23) the agreement reached between the representatives of the Council of the EU and the European Parliament at the end of June 2020 (see EUROPE 12517/14). As a reminder, the agreement maintains the flagship element of the Commission’s proposal, i.e., to enable courts to exchange information electronically and across borders through a decentralised computer system which will be composed of national computer systems interconnected by national access points. It also retains the possibility of hearing witnesses by videoconference. The texts will now be submitted to the European Parliament for final adoption. (MF)
