Council green light for definitive adoption of directive on 'proportionality test'

22/06/2018 (Agence Europe) – On Thursday 21 June, the member states of the EU gave their final green light to the inter-institutional agreement (see EUROPE 11986) on the directive on the proportionality test before adoption of new regulation for the professions. The agreement grants the member states more discretion in a number of areas, particularly with regard to the healthcare professions. The list of justifications for taking restrictive measures will remain open and take into account the case law of the European Court Justice (ECJ). The member states will have to carry out a public consultation with all involved stakeholders before introducing new rules. The text will now be published in the EU Official Journal. (PH)
