Luxembourg, 04/12/2003 (Agence Europe) - the Court of First Instance has ruled out a decision by a board of appeal at the Community Trade Marks Office in Alicante refusing Nestlé Waters France, during the time of Perrier Vittel France for registering its Vittel water bottle a Community mark. The bottle is a slightly truncated cone with wavy grooves and a blue cap.
The refusal of the board of appeal was based on the bottle being "devoid of any distinctive character".
