Brussels, 14/07/2003 (Agence Europe) - The Commission has decided to pursue the infringement proceedings initiated against four Member States - Belgium, Spain, France and Luxembourg - for failure to comply with the Directive 1999/44/EC on legal guarantees for consumer goods in the case of defects in the product bought within the EU. These countries will be brought before the European Court of Justice (third stage in procedure) for not having correctly transposed into internal law all or part of the provisions of the directive, given that the time allowed for completing the obligation of transposition expired on 1 January 2002. After a call to order, Spain did notify the Commission of its national measures for transposition, but its tranposition is partial. The three other Member States have still not taken any measures for transposing the directive. The legal guarantee of a product (as opposed to the commercial guarantee) confers upon EU consumers the right to have the product repaired or replaced within two years following supply of the product if the product is faulty.
