Explicit ban on AI models that generate sexual deepfakes does not convince European Commission

The issue of banning artificial intelligence models capable of generating sexual deepfakes is being debated by the various European institutions (see EUROPE 13807/6).

In her response to a written question tabled by four EPP MEPs, Commissioner for Tech Sovereignty, Security and Democracy Henna Virkkunen believes that the legislative texts already in place, starting with the Digital Services Act and its plethora of open procedures, are already sufficient to ensure a degree of compliance by the platforms concerned (see EUROPE 13794/9).

The commissioner says she is “aware of the fact that Member States and Members of European Parliament are proposing [...] to include explicit bans on these AI systems”, but does not give a definitive opinion on the issue.

Among the EU27, according to a working document on the AI omnibus (see EUROPE 13807/5) consulted by Agence Europe, France and Spain want an explicit ban on “the placing on the market, putting into service or use of an AI system designed to generate, modify or reproduce sexually explicit content or images of nudity in violation of the dignity, sexual integrity or consent of natural persons“.
