European Parliament called on European Commission for a ‘proposal’ on use of algorithmic management at work

Contrary to what we wrote in issue 13775, while the European Parliament did call for “new rules” to govern algorithmic management in the workplace, the EPP succeeded in getting an amendment adopted removing the reference to a “legislative” proposal, so that the European Parliament is now simply asking for a “proposal”. The plenary vote therefore weakens the text adopted by the European Parliament’s Committee on Employment and Social Affairs, which explicitly referred to a “legislative” proposal (see EUROPE 13759/29). For other European Parliament sources, however, this does not make much difference and Parliament continues, they say, to call for a legislative framework. It is emphasised at the European Parliament, particularly within the left-wing groups, that this is an own-initiative report and this type of report always calls for legislative acts. The adopted text also asks the Commission to “present, on the basis of Article 153(2)(b), in conjunction with Article 153 (...) and Article 16 (...) of the TFEU (...) a proposal on algorithmic management in the workplace, which would fill the remaining gaps in the existing legislation”.
