In a judgment (C-422/24) published on Thursday 18 December, the Court of Justice of the EU, on a request for an opinion from a Swedish court, has ruled that owners of pedestrian cameras, such as ticket inspectors on public transport, must clearly inform the people filmed that their data is being processed.
A Swedish public transport company (Storstockholms Lokaltrafik) has gone to court to challenge a fine imposed by the country’s data protection authority for failing to provide sufficient information to those filmed about the use of their data.
The CJEU ruled that the people filmed must have immediate information about the processing of their data. This can be done with a warning sign for the most important information. Other information that must be communicated can be done so “in an appropriate and complete manner, in an easily accessible place”.
The information to be provided includes the identity and contact details of the data controller, the purposes, the legal basis, the recipients, the retention period and the right to request access to and erasure of the data. (Original version in French by Léa Marchal)
