27/10/2025 (Agence Europe) – On Monday 27 October, the Council of the European Union formally adopted the first text of the ‘patent’ package presented in 2023: the regulation introducing the European compulsory licence (see EUROPE 13171/1). Negotiators from the Council and the European Parliament reached a provisional agreement on this text in May (see EUROPE 13646/3). The regulation will enable the EU to issue compulsory licences in certain crisis situations and allow a company to use a patent without the authorisation of the patent holder. The European Parliament still has to approve the agreement before it can be published and enter into force. (LM)
