European Commission has only twice amended regulatory framework governing EU aviation safety list since 2006

The European Commission has twice exercised its power to adopt delegated acts to amend and enhance the regulatory framework governing the EU Air Safety List since it came into force in 2006, according to the European Commission’s report to the EU Council on Friday 4 July.

This 2006 regulation defines common criteria for imposing an operating ban on an air carrier, based on the relevant safety standards. It also provides for making available information on the identity of the operating air carrier, thereby ensuring transparency for passengers.

Moreover, the Regulation mandates that EU Member States enforce, within their territory, the operating bans on air carriers that are included in the EU Air Safety List.

The first amendment replaced Regulation 473/2006 with updated procedural rules that strengthen legal certainty, efficiency and the right of defence for air carriers subject to an operating ban. The second amendment refined the common criteria used to assess operating bans, ensuring better alignment with the European Union Aviation Safety Agency’s (EASA) system for authorising third country operators.
