On Friday 7 March, the six gatekeepers designated by the European Commission under the Digital Markets Act (DMA) published their updated compliance report for the year 2025.
Of the six companies - Apple, Alphabet (Google), Meta, Amazon, ByteDance and Microsoft - three are officially under investigation by the Commission for non-compliance: Apple, Google and Meta (see EUROPE 13378/8).
In its updated report, Meta accuses the Commission of making additional demands that fall outside the strict scope of the DMA: “Despite Meta’s concerted efforts to comply with European regulations, we have continued to receive additional requests that go beyond what is written in the law. [...] During the compliance period, Meta went beyond the requirements of the DMA by working closely with the European Commission and third-party courier services”, the report states.
Apple, which is also at odds with the Commission over some of the company’s compliance with the DMA, explains in its report that it is “a factual record of the measures put in place under the DMA. It is not, and should not be construed as, a statement of the position of Apple on the validity, scope and correct application of the provisions of the DMA. The measures set out in this report reflect Apple’s desire to respond to the issues raised by the European Commission, without prejudice to Apple’s legal position”.
Microsoft is delighted with the functionality of Windows, which complies with the DMA as soon as the operating system is launched: “Microsoft’s approach to DMA compliance has been guided by three fundamental principles: transparency, accountability and open engagement. [...] Windows users were free to choose their preferred browsers, application shops and software solutions before the DMA made this a requirement”, the report details.
The Commission’s annual report on the implementation of the Regulation was due to be published on Friday 7 March, but was still not available at the time of writing.
