EU preparing to impose retaliatory measures on New Delhi in dispute over information and communication technologies

On Thursday 28 November, the European Commission began consultations with India at the World Trade Organization (WTO) with a view to resolving the dispute over Indian tariffs on certain European information and communication technologies (ICTs). The WTO ruled in 2023 that these tariffs were in breach of WTO rules (see EUROPE 13164/30), but New Delhi then appealed this ruling in December 2023, although the Appellate Body has been blocked for several years. However, the EU’s trade compliance regulation (2021) allows it to take measures against a third country that has been found to be at fault by a panel. At the end of this WTO consultation phase, which ends on 10 February 2025 at the earliest, the EU will be able to prepare trade measures against India. (LM)
