The European Commission decided to open a number of infringement procedures by sending letters of formal notice to 18 Member States, criticising them for failing to appoint a coordinator to implement the Data Governance Act.
The 18 countries concerned are Austria, Belgium, Cyprus, the Czech Republic, Estonia, France, Germany, Greece, Italy, Latvia, Luxembourg, Malta, Poland, Portugal, Romania, Slovakia, Slovenia, and Sweden.
In place since September 2023, the Data Governance Act envisages facilitating data sharing among EU countries and sectors (see EUROPE 12844/21). The 18 Member States have 2 months to respond to the European Commission. Once this deadline has passed, the European Commission may decide to issue a reasoned opinion, the last step before the matter is referred to the Court of Justice of the EU.
