Greece is referred to EU Court of Justice for failing to correctly transpose EU rules on proportionality of professional regulations

On Thursday 23 May, the European Commission decided to refer Greece to the Court of Justice of the EU in the infringement proceedings opened against Athens, accused of failing to comply with the Proportionality Test Directive. This requires Member States to assess the proportionality of any new rule restricting access to the regulated professions, and which applies since July 2020.

According to the Commission, the Greek authorities “have not transposed with sufficient clarity the criterion of systematic or regular proportionality review over time”. It opened infringement proceedings against Greece in December 2021, followed by a reasoned opinion in October 2023. The problem has not been resolved, despite discussions with the Greek authorities, according to the Commission. 

Greece is not the only country to be referred to the Court. The Commission did the same with the Czech Republic in April (see EUROPE 13398/48). (Original version in French by Léa Marchal)
