European Commission details sectors that Member States should target to identify and protect their critical entities

On Tuesday 25 July, the Commission adopted a delegated act detailing a list of essential services and sub-services to be protected within the eleven sectors covered by the new Directive on critical entities resilience (CER), which came into force in January, it said in a press release (see EUROPE 13081/2).

Critical entities provide essential services to maintain key societal functions, support the economy, ensure public health and safety and preserve the environment”, explains the Commission. Under the new directive, Member States will have to identify critical entities in defined sectors by 17 July 2026.

They will use this list of essential services to carry out a risk assessment and then “identify the critical entities that will have to take measures to enhance their resilience”.

The Commission has therefore proposed a non-exhaustive list of services and sub-services that are essential for maintaining the vital functions of these economic sectors and activities in the eleven sectors covered by the directive: energy, transport, banking, financial market infrastructure, health, drinking water, waste water, digital infrastructure, public administration, space and the production, processing and distribution of foodstuffs.

Examples of services and sub-services include, for transport, the sub-sector of air transport for commercial purposes (passengers and freight) or the operation, management and maintenance of airports; for water, river, maritime and coastal transport services or the management and maintenance of ports and port facilities.

For the healthcare sector, the list covers the provision of healthcare services (healthcare providers), the research and development of medicines and the manufacture of medical devices considered critical in the event of a public health emergency.
