19/04/2023 (Agence Europe) – On Wednesday 19 April, the European Commission decided to refer the Netherlands and Portugal to the Court of Justice of the European Union for failing to transpose into their national legislation the rules on the posting of lorry drivers agreed in 2020 (see EUROPE 12389/7). Applicable since February 2022, the directive (2020/1057) introduces measures to control the posting of these drivers and amends the directive (2006/22/EC) governing the control of other social legislation in road transport. The lack of transposition creates problems for drivers, who want to be fairly remunerated, for authorities, who need to enforce the rules properly, and for operators, who need a clear legal framework to conduct their business, the Commission said in a statement.
