02/03/23 (Agence Europe) – The NGOs PAN Europe (Pesticide Action Network Europe) and Nature & Progrès Belgium announced on Wednesday 1 March that they have given the Belgian State formal notice to comply “within 15 days” with the judgment of the Court of Justice which condemned it in January (case C-162/21) for abusing emergency derogations (Article 53 of the ‘Pesticides’ Regulation) for banned pesticides (see EUROPE 13103/28). At issue: the Belgian authorities’ maintenance of a derogation for the use of indoxacarb, an insecticide banned in the EU. “A formal notice” has been sent to the Belgian Federal Minister of Agriculture, David Clarinval, after a letter sent to him at the end of January “asking him to cancel the derogation without delay” remained unanswered, according to the NGOs.
