16/09/2022 (Agence Europe) – The Legal Service of the Council of the EU validated, in a document dated 12 September, after discussions in the EU Council’s Telecommunications Working Party last 7 April, the legal basis chosen by the European Commission - Articles 16 and 114 of the Treaty on the Functioning of the EU - for future legislation on harmonised rules on artificial intelligence (AI) (see EUROPE 13014/30). Specifically, the lawyers considered that Article 114 of the TFEU, on decisions on all provisions aimed at approximating the laws of the EU countries, is “the only appropriate legal basis”. In addition, the lawyers also confirmed that TFEU Article 16, regulating the processing of personal biometric data ‘in real time’ in publicly accessible areas for the prevention of crime, is complementary to it.
