European Commission submits parts of CAP secondary legislation to Member States

The European Commission has started to submit parts of the secondary legislation on the new Common Agricultural Policy (CAP) to the EU Member States. This was confirmed at the meeting of the Special Committee on Agriculture (SCA) on Monday 8 November.

The Commission is preparing a new draft implementing act on future national strategic plans (see EUROPE 12809/3).

The EU Council still hopes to adopt the three CAP reform regulations on 2 December, if the European Parliament ratifies the compromise texts at the 22-25 November plenary.

If this happens, the urgent secondary legislation could come into force during December. Non-urgent secondary legislation would be adopted in early 2022.

The Commission reportedly told SCA experts that the initial requirement for Member States to specify how their strategic plans would contribute to the objectives of the ‘European Green Deal’ was being reviewed and that the objections expressed by EU agriculture ministers in October would be taken into account.

Delegations to the SCA reported that: - the basic legislation should be finalised in time; - secondary legislation should not go beyond the scope defined in the basic legislation; - secondary legislation should not impose an additional administrative burden on local authorities and/or beneficiaries.
