Josep Borrell promises “robust response” to Polish Constitutional Tribunal judgement

The High Representative of the Union for Foreign Affairs and Security Policy, Josep Borrell, promised that the European Commission's response to the Polish Constitutional Tribunal's judgment that questioned the rule of EU law would be “robust” on Tuesday (see EUROPE 12807/1 and 12808/1).

Let's be clear: if you are a member of a club, you must abide by its rules. And the primacy of EU law over national law is the most important rule of the club”, Mr Borrell said regarding the sidelines of the EU/Ukraine summit (see separate story), Reuters reported. Otherwise, the club cannot function as a Union, he added.

In Brussels, EU Budget Commissioner Johannes Hahn said that the judgment needs a thorough analysis and “requires a reaction from us”.

The European college of Commissioners will discuss the recent judgment of the Polish Constitutional Tribunal on Wednesday, said Dana Spinant, deputy spokesperson of the European Commission. The judgment is now binding after the Polish government published it in the Official Journal on Tuesday.

The Slovenian Presidency of the Council of the EU, however, did not put the issue on the agenda of the meeting of Member States' ambassadors to the EU (Coreper) that took place on Wednesday.

This issue could be taken up directly by the European Council at its summit meeting on Thursday 21 and Friday 22 October, if one of the leaders wants to ask his Polish counterpart for explanations. (Original version in French by Mathieu Bion)
