09/06/2021 (Agence Europe) – The European Commission announced on Wednesday 9 June that it is referring Poland to the EU Court of Justice over its incorrect implementation of the public procurement directives (2014/24/EU, 2014/25/EU and 2014/23/EU). While the EU’s public procurement directives provide for certain derogations for the award of contracts without tendering, the European guardian of the Treaties considers that these do not apply to the broad categories of contracts exempted by the Polish law. In particular, the Commission considers that the Polish exemptions for the production and distribution of public documents and bank resolution services infringe EU law. The Commission sent Poland a letter of formal notice on 25 January 2019 and a reasoned opinion on 28 November 2019. (PH)
