On Wednesday 9 June, the European Commission sent a letter of formal notice to Hungary, asking the country to implement the December 2020 Court of Justice judgment on asylum procedures.
This judgment had, among other things, convinced Frontex to suspend its activities in Hungary (see EUROPE 12625/30, 12646/6).
“The Commission believes that Hungary has not taken the necessary measures to comply with the judgment, in particular as regards the violation of the relevant provisions of the Asylum Procedures, Reception Conditions and Return Directives”, the EU institution said.
On the same day, the Commission sent another letter of formal notice and a reasoned opinion to the Hungarian authorities asking them to confirm that Hungary had notified the full transposition of the 2013 Asylum Procedures Directive.
“The reasoned opinion follows the letter of formal notice sent by the Commission in September 2015, covering the provisions relating to personal interviews, medical examinations, and safeguards for unaccompanied children and adolescents. And the letter of formal notice covers additional provisions on the procedure for examining asylum applications, which were to be transposed later”, according to a statement from the EU institution.
