On Monday 14 December, the European Commission published a report on the implementation of the 2014 Directive on certain rules governing damages actions under national law for infringements of competition law.
This legislation helps citizens and businesses to claim damages if they are victims of infringements of EU antitrust rules, such as cartels or abuses of dominant market positions.
The Commission has drawn positive conclusions from this report on the implementation of these rules. By 2018, all Member States had implemented the Directive. The Commission has assessed whether the national implementing rules comply with the Directive. The assessment did not reveal any systemic issues.
The report notes that, since the adoption of the Damages Directive in 2014, the number of damages actions before national courts has significantly increased.
The Commission intends to continue to monitor developments in the Member States with a view to reviewing the Directive, once sufficient experience from the application of its rules is available.
