European Parliament confirms its position on revision of ‘Motor Insurance’ Directive

On Wednesday 13 February, the European Parliament adopted, without amendment, the proposal for a directive to strengthen compensation for road accident victims in a cross-border context (see EUROPE 12177). 

Dita Charanzová (ALDE, Czech Republic), rapporteur on this issue, once again welcomed "the right balance between greater protection for road accident victims and preventing absurd over-regulation". 

The Parliament’s position on the revision of the Motor Insurance Directive (2009/103) does not change the minimum amounts of compensation suggested by the Commission, namely: - for personal injury: 6.07 million euros per accident, irrespective of the number of victims, or 1.22 million euros per victim; - for property damage: 1.22 million euros. 

On Wednesday, MEPs rejected the S&D group's amendments setting at: - 10 million euros per accident, regardless of the number of victims, or to 2 million euros per victim, compensation for personal injury; - 2 million euros compensation for material damage. 

The text supported by MEPs provides that a national compensation fund should compensate victims of an accident within six months at the latest in the event of the insurer's insolvency. A specific mechanism is introduced for cross-border situations. 

MEPs excluded electric bicycles, segways and electric scooters from the scope of the future rules. (Original version in French by Mathieu Bion)
