Court defers to national court to determine liability of notified body in breast implants case

Claim for compensation for non-material damage submitted by persons who have had PIP breast implants fitted which did not comply with quality standards should be dealt with by member states’ courts. Thus ruled the Court of Justice of the EU on Thursday 16 February in a case (C-219/15) brought by a German woman against the national notified body, after a similar case in a French court.

In 2008, Mrs Elisabeth Schmitt had breast implants that had been manufactured in France by the company PIP...
