28/11/2007 (Agence Europe) - In a ruling issued on 22 November 2007, the European Court of Justice rejected an appeal by Deutsche Telekom against the German telecoms regulator Bundesnetzagentur (Case-262/06). The German historic telecoms operator appealed to Germany's national administrative court against Bundesnetzagentur's demand for Deutsche Telekom's charges to be approved by explicit authorisation. Through this ruling, the Court of Justice is answering a question from German justice about whether such an authorisation is in fact necessary under EU Directives 2002/21/EC and 2002/22/EC given the dominant position of Deutsche Telekom on the retail market in question.
