Brussels, 14/12/2006 (Agence Europe) - On 12 December, the European Commission sent a reasoned opinion to Malta for non-compliance with Community rules on maritime cabotage. In April 2004, concluded an exclusive public service contract with a private operator to provide maritime services to Gozo. It did not, however, justify the need for such a contract. Moreover, the contract was signed without a prior tender procedure. Under the regulation applying the principle of freedom to provide services to maritime transport within Member States, the operators concerned must be allowed to operate freely in this type of market. Exceptions to this principle are only granted in special circumstances. The reasoned opinion is the final stage before referral to the Court of Justice. (dt)
