Brussels, 19/03/2004 (Agence Europe) - The EP Committee on Energy decided on Wednesday to modify the legal basis of the draft Directive aiming to guarantee safe gas supply in the EU. Contrary to its February decision (by a very narrow majority) the EP committee accepted the proposal by the Committee on Energy of 15 December 2003 to change the legal basis of the proposal from Article 95 (co-decision) to Article 100 (the Council decides alone, with possible consultation of the Parliament). For the Council, the absence of provisions on the internal market in the proposal justifies the change in the legal basis (see EUROPE of 16 December, p.11). The Committee on Energy took this decision after consulting the Parliament's legal committee. The plenary session will vote in the last instance on the legal basis of the proposal in March tor April.
