Brussels, 28/11/2003 (Agence Europe) - DG Competition at the European Commission is planning to soon propose an end to the unlimited guarantee enjoyed by the French company EDF, to the College of Commissioner. This will affect its public status when contracting loans. This provision enables the company to escape the law on insolubility and bankruptcy. The company will be transformed on this occasion into a limited company, a change that will also be accompanied by an obligatory reform in the internal pensions systems at EDF. The document also raises the question of reimbursement to the France state of around EUR 888 million which corresponds to the fiscal incentives unduly granted to EDF by way of a corporate tax derogation. Spokesperson Tilman Lueder, has explained that at this stage this will involve an inter-service consultation document that has not yet received the green light from Commissioner Mario Monti. The Commission has opened two separate procedures into ED: one at the end of 2002 on reimbursement of tax incentives received in 1987 and 1996 and the other in Spring 2003 involving the unlimited guarantee enjoyed by the firm. A single decision could put an end to these two procedures, added Mr Lueder.
