GENERAL NEWS / (eu) eu/free movement of capital

05/02/2003 (Agence Europe) - The European Commission has sent reasoned opinions to the Netherlands requesting it to review the special powers accorded to the holder of the "golden share", namely the Dutch State, in the capital of the companies KPN and TPG. It considers such rights conflict with the free movement of capital and right of establishment. Invoking similar reasons, it will be sending a letter of formal notice to Italy regarding the legislation that fixes the criteria for implementing special prerogatives in privatised firms. Rome will also receive a letter of formal notice on the national provisions whereby professionals must be included on Italian official registers in order to carry out certain advisory tasks concerning privatisation. EUROPE will be coming back to this.
