European Commission updates scope of products covered by ‘deforestation regulation’

The European Commission adopted, on Monday 13 July, two measures aimed at facilitating the implementation of the EU Deforestation Regulation (EUDR), which will start to apply from late December (see EUROPE 13900/17)

The delegated act (https://aeur.eu/f/mv1 ) amends Annex I to the Regulation, following a consultation of stakeholders and the public. The following are removed from the scope: - cattle hides, skins and leather; - retreaded pneumatic tyres; - soya bean seeds intended for sowing; - certain articles of vulcanised rubber; - conveyor and transmission belts; - aircraft and motor vehicle seats.

Meanwhile, the following are added: - soluble coffee; - certain palm oil derivatives; - frozen cattle tongues.

All these changes were assessed according to the methodology presented in a working document published with the draft delegated act on 4 May.

In order to give businesses time to adapt, the new products included in the Regulation will be subject to its obligations only from 30 December 2027. This update does not alter the list of the seven commodities covered, but only certain products derived from them.

The delegated act also stipulates that samples and products used for analysis, examination or testing purposes are excluded from the scope. It also introduces targeted exemptions for certain product categories, notably waste, used or second-hand products, packaging materials and products used in the manufacture of medicines. The text will now be forwarded to the European Parliament and the Council of the European Union for scrutiny before its entry into force.

The Commission also adopted the implementing act (https://aeur.eu/f/mv2 ) establishing the technical rules for the Information System, with several simplifications: - simplified statements for micro-enterprises and small businesses operating upstream in the supply chain; - updated technical specifications for application programming interfaces (APIs).

New functionalities will be added over the summer. After the necessary technical updates, the Information System reopened in late June. The Commission plans to continue improving it, to update its documentation regularly and to organise training sessions for businesses from late July.
