European Commission seeks contributions on draft guidelines on trusted flaggers under DSA

Between 29 May and 26 June, the European Commission is seeking contributions on its draft guidelines on ‘trusted flaggers’, whose notices reporting illegal content – child sexual abuse, infringements of intellectual property rights or online fraud – must be treated as a priority by online platforms under the Digital Services Act (DSA). Platforms nevertheless remain responsible for verifying whether the reported content is in fact illegal.

The draft guidelines define the criteria and procedure for granting this status and provide guidance on the technical requirements for processing notices. They propose measures designed to preserve the integrity of the mechanism and to avoid any abusive use, such as the publication of annual reports by trusted flaggers or procedures that allow this status to be suspended or withdrawn.

The European Commission plans to adopt the final guidelines in the second half of 2026. The Bank of Ireland, Someturva and Child Focus are among more than 70 trusted flaggers who have already thus been designated.
