On Wednesday 1 April, the Committee of Permanent Representatives of the Member States to the EU approved the texts of the agreement and the decisions on the signature and provisional application of the Agreement between the EU and the United Kingdom on Gibraltar (see EUROPE 13810/21).
The texts will be formally adopted as soon as the checks carried out by the EU Council’s lawyer-linguists have been completed. The agreement is due to enter into force provisionally on 15 July 2026, according to an EU Council press release.
Gibraltar is not included in the scope of the EU-UK Trade and Cooperation Agreement, signed in 2020 and in force since 2021.
In relation to the movement of persons, the parties have agreed to introduce dual border controls - Gibraltar and Schengen - at Gibraltar’s port and airport, to be carried out in full cooperation between EU and UK/Gibraltar authorities.
For the EU, full Schengen checks will be carried out by Spain. For the United Kingdom, full Gibraltar checks will continue to be carried out with no change to the current situation.
Concerning goods, the principles governing the future customs union between the EU and Gibraltar, as well as those concerning the indirect taxation to be applied in Gibraltar, including on tobacco, have been agreed. (Original version in French by Solenn Paulic)
