X challenges €120 million fine imposed on it under DSA, before EU General Court

On Monday 16 February, the US social network X filed three appeals with the EU General Court against the European Commission and the €120 million fine imposed on it by the latter in December (see EUROPE 13767/1), the first fine for non-compliance under the Digital Services Act (DSA).

The appeals were filed by the three entities targeted by the fine, namely Elon Musk, X and xAI Holdings. In a post on the ‘Global Government Affairs’ X account , the company launched a vitriolic attack on the European decision: “this EU Decision resulted from an incomplete and superficial investigation, grave procedural errors, a tortured interpretation of the obligations under the DSA, and systematic breaches of rights of defence and basic due process requirements suggesting prosecutorial bias”, it claimed.

For its part, the Commission states that it has “taken note” of this appeal and is “ready to defend its decision before the courts”. (Original version in French by Isalia Stieffatre)
