On Monday 22 December, the Italian competition authority (AGCM) fined Apple €98.635 million for abusing its dominant position in the market for application developers. The AGCM believes that the American giant is “imposing conditions that are too restrictive” on the development of third-party options, particularly with regard to the privacy of the platform’s users. These conditions “are imposed unilaterally, harm the interests of Apple’s commercial partners and are not proportionate to the objective of respecting privacy”, according to the AGCM. The European Commission says it has “taken note” of the Italian decision, which was taken in cooperation with the European regulatory authorities. Apple has already been condemned by the EU for breaches of the Digital Markets Act, specifically concerning the opening of its App Store to external developers (see EUROPE 13626/2). (IS)
