The European Commission is closely monitoring developments regarding the US Foreign Account Tax Compliance Act (FATCA) aimed at combating tax evasion, according to a response to a written question from the European Parliament on Tuesday 22 July. It is monitoring the situation in collaboration with the European Data Protection Board (EDPB).
Michael McGrath, European Commissioner for Democracy, Justice, the Rule of Law and Consumer Protection, said he would “also continue to work with the authorities of the United States (US) including in the context of the bi-annual EU-US Regulatory Forum”. At the same time, the Commission is in close contact with the Member States, notably within the Council Working Party on Tax Questions, where the Member States exchange views on the implementation of their international agreements in this area, including data protection safeguards.
The EDPB invited Member States to assess their existing international agreements and to review them. For example, the Belgian Data Protection Authority has decided to prohibit the Federal Finance Service from transferring personal data to the US authorities (see EUROPE 13628/14).
