European Commission continuing consultations on application of legislation for ‘net-zero emissions’ industry (NZIA)

The European Commission has opened two further consultations on the implementation of the ‘Net-Zero Industry Act’ (NZIA) (see EUROPE 13564/33, 13565/18). It grants flexibilities for setting up manufacturing sites for certain clean and strategic technologies in the EU.

The first consultation concerns the implementing regulation that will establish the list of final products and main components of ‘net-zero emission’ technology for which the resilience criterion applies in certain public procurement and auctions. The products and components listed in the implementing regulation will be able to benefit from the resilience criterion when they take part in public procurement or an auction, provided that the EU is 50% dependent on a single third country for the same product.

The second call for contributions concerns guidelines designed to ensure uniform conditions in the selection criteria for projects considered strategic. This includes details on how to quantify additional manufacturing capacity, or how to assess a first-of-a-kind facility.
