06/09/2024 (Agence Europe) – On Friday 6 September, the European Commission decided to withdraw several of its earlier decisions concerning Illumina’s acquisition of GRAIL. This announcement follows the decision by the EU Court of Justice on Tuesday 3 September to annul the Commission’s decision to review the legitimacy of the acquisition under Article 22 of the EU Merger Regulation (see EUROPE 13474/12). The six decisions withdrawn are: - the opening of a phase II investigation into Illumina’s proposed acquisition of GRAIL in July 2021; - the prohibition of the acquisition in September 2022; - two decisions on interim measures adopted in October 2021 and 2022; - the implementation of restorative measures requiring Illumina to unwind its acquisition of GRAIL; - fines on Illumina and GRAIL for implementing their merger before Commission approval.
