European, British and American authorities are adopting a common position in an attempt to protect competition in field of AI

On Tuesday 23 July, the European Competition Commissioner, Margrethe Vestager, the U.K. Competition and Markets Authority, the U.S. Department of Justice and the U.S. Federal Trade Commission issued a statement reaffirming common principles to protect competition in the AI ecosystem. 

An AI that, having reached a technological inflection point, can offer opportunities, but also expose us to risks. The signatories reaffirm the sovereign nature of their respective decisions and legal systems, but stress the cross-cutting nature of certain identified risks.

Accordingly, the authorities have indicated that they will try to pool their efforts to gain a better understanding of the problems.

They also undertake to use their respective powers, where appropriate, to ensure fair competition based on equity, interoperability and protecting the ability of consumers and businesses to choose.

Among the potential risks, the various competition authorities are calling for vigilance and to guard against, in particular, attempts to restrict inputs essential to the development of AI technologies or the strengthening of market power, which already dominant companies would use to increase barriers to competition.

The signatories also warn against the risk of restricting choice for content creators or developing or using AI to harm consumers, business owners or other market players.

Finally, the signatories believe that AI could facilitate anti-competitive practices, such as restrictive agreements.
