On Friday 17 May, the European Commission announced that it had sent a request for additional information to the search engine Bing concerning the specific risks associated with its generative artificial intelligence (AI) functions.
An initial request for information was sent in March, but no response was received from the platform. The Commission is now requiring Bing to provide the information requested by 27 May, failing which it may consider imposing sanctions.
This legally-binding request, made under the Digital Services Act (DSA), concerns two Bing features which are based on generative AI, namely ‘Copilot in Bing’ and ‘Image Creator by Designer’.
This decision comes at a time when the EU and the European authorities responsible for ensuring the proper implementation of the DSA are paying particular attention to the preparations for the forthcoming electoral period and the dangers that could emerge online.
The Commission believes that Bing has not sufficiently studied the risks that these features may pose, particularly with regard to the viral dissemination of deepfakes and the automated manipulation of services, which could mislead voters. (Original version in French by Isalia Stieffatre)
