14/12/2023 (Agence Europe) – On Thursday 14 December, the European Commission sent requests for information to Google and Apple under the Digital Services Act (DSA) (see EUROPE 13310/37). In particular, the Commission wants to ask these companies to provide more information on how they have “diligently” identified systemic risks concerning the App Store and Google Play services. The deadline for responses is 15 January 2024. If these responses fail to convince the Commission, proceedings could be formally opened. In the worst-case scenario, this could lead to fines of up to 6% of the company’s annual worldwide sales. In recent months, the Commission has already sent requests for information to several other companies, including X (formerly Twitter) (see EUROPE 13271/13), Meta, TikTok (see EUROPE 13275/4) and AliExpress (see EUROPE 13286/8).
