Spanish Presidency of Council of EU and European Parliament will try to find possible compromises on legal presumption for digital platform workers

Contrary to what we wrote regarding digital platform workers (see EUROPE 13289/22), the Spanish Presidency of the Council of the EU has asked the European Parliament to provide it with a new written proposal reiterating its priorities on the legal presumption of employment, but has also understood, according to some sources, that the Council must also make a gesture in favour of the European Parliament if it wants to reach a solution. Although the mandate of the Council of the EU, like that of the European Parliament, is very limited, both parties will be working on possible alternatives. The Council of the EU should therefore, in principle, look for new solutions on the basis of the new leads sent by the European Parliament and not simply ask the European Parliament to find a way to work around its mandate, as we have misinterpreted it.
