The European Commission is seeking the views of stakeholders on the commitments proposed by Renfe Operador, for an indefinite period, to remedy a possible abuse of a dominant position on the Spanish market for online rail ticketing services by Renfe (see EUROPE 13172/9).
In particular, Renfe offers to make all current and future real-time data and content available on its online channels to third-party online ticketing platforms, dynamically and with a few procedural exceptions.
The Spanish rail company is also proposing to inform third-party ticket offices, at least four months in advance, of its decision to include new content or data in real time, and to inform them of the technical specifications at least one or two months in advance, to allow competitors to adapt their IT systems.
Finally, Renfe proposes to apply to third-party ticketing platforms, where applicable, a maximum average monthly conversion rate (i.e. the ratio between the number of requests made to Renfe's ticketing service concerning ticket sales and the number of actual sales made) of at least 140.
Renfe also undertakes not to exceed an error rate (i.e. the ratio between the number of failed booking requests and the total number of booking requests) of at most 14.23%.
