04/05/2023 (Agence Europe) – On Thursday, 4 May, the European Data Protection Supervisor (EDPS) issued five opinions on the European Commission’s recommendations to open negotiations for international agreements on the exchange of personal data between Europol and five Latin American countries—Bolivia, Brazil, Ecuador, Mexico, and Peru—in order to fight crime and terrorism. The EDPS recommends that future international agreements explicitly list the criminal offences and the purposes for which data may be exchanged. They should also provide for a periodic review of the duration that data is stored. Transfers of data obtained in a way that violated human rights should be excluded as well. The parties concerned should also regularly exchange information on the respect of fundamental rights and on the application of oversight and redress mechanisms.
