DMA - European Commission clarifies procedural rules for designation of gatekeepers

On Monday 17 April, the European Commission adopted new procedural rules on the implementation of the Digital Markets Act (DMA) (see EUROPE 13157/32).

The new rules therefore include the notification form that the ‘gatekeepers’ must use when providing certain data as part of the Commission’s process for appointing gatekeepers.

As a reminder, the DMA foresees, among other things, that companies with a stock market value of up to €75 billion, an annual worldwide turnover of €7.5 billion and a minimum of 45 million monthly users in the EU, will be designated as gatekeepers.

In addition, the adopted rules detail certain aspects concerning the application of the DMA, including the right of the parties to be heard during the proceedings. Other provisions provide for the establishment of a simplified procedure for access to the file.

The Digital Markets Act came into force on 1st November (see EUROPE 13054/14). The new rules adopted by the Commission are partly based on the contributions collected by the Commission during the public consultation which was open between 9 December 2022 and 9 January 2023.
