European Commission adopts a proposal for a Regulation to facilitate cross-border data exchange within public administrations

On Monday 21 November, the European Commission adopted its new proposal for a Regulation on Interoperable Europe. This text should, among other things, establish a framework for cooperation between the public administrations of the EU Member States in order to facilitate the secure cross-border exchange of data. In addition, the text should also enable different public administrations to agree on common digital solutions and reduce the administrative burden, costs and delays for European citizens, businesses and the public sector.

In detail, the text provides - in addition to cooperation between public administrations - for assessments to measure the impact of changes in IT systems on cross-border interoperability in the EU.

In addition, the European Commission intends to make the future ‘Interoperable Europe’ portal the access point to facilitate cooperation between different entities, especially when it comes to the exchange and re-use of data.

The ‘Interoperable Europe’ committee will be responsible for steering the future framework provided for in the text. It will be composed of representatives from the Member States, the Commission, the Committee of the Regions and the European Economic and Social Committee.

The text also provides for setting up regulatory sandboxes - which should allow market players to test the technology or service developed without necessarily having to comply, for a limited period of time, with the entire normal regulatory framework - as well as assistance with training.

According to the Commission’s calculations, this future Regulation to facilitate data flows within the EU is expected to save EU citizens between €5.5 and €6.3 million. For private companies dealing with public administrations, these savings could reach €5.7 to €19.2 billion.
