17/11/2022 (Agence Europe) – The Court of Justice of the European Union has ruled that the Directive (2000/78/EC) introducing a general framework for equal treatment in employment and occupation, read in the light of the EU Charter of Fundamental Rights (Article 21), precludes Italian legislation which sets the maximum age limit for taking part in the competition for the recruitment of police commissioners at 30 years, in a judgment delivered on Thursday 17 November (Case C-304/21). In its view, the duties actually performed by a police commissioner do not require any particular physical ability or, if such physical ability is required, the Italian legislation imposes a disproportionate requirement, a situation which it is for the court which referred the case to verify.
