Brussels, 06/10/2022 (Agence Europe) – In a judgment delivered on Thursday 6 October, the European Court of Human Rights said that it would be a serious violation of the Convention if Poland proceeded with the extradition of the applicant - Hung Tao Liu - to China, a procedure authorised in 2020 by the Polish courts, but denounced as early as 2018 by the Court and by the Commissioner for Human Rights. The situation within the Chinese prison system can be likened to “a general situation of violence”, the Strasbourg judges said, denouncing a potential violation of Article 3 of the Convention (prohibition of torture and inhuman and degrading treatment). The applicant, who is currently detained in Warsaw, was the subject of a red notice in the context of a Sino-Spanish investigation into a telecommunications fraud ring.
